Vista's Building Division is the office for any ADU, remodel, addition or new house inside the city, and every application now goes in through the City's online portal, with Land Development Engineering clearing the grading before the plans are accepted. Vista's ADU chapter was last amended in March 2024, to allow three bedrooms up to 1,200 square feet, and nothing since has caught it up with the state's 2024 and 2025 bills, so on several points the statute overrides it: an ADU may rise above one story and 16 feet where the state allows, a multifamily lot may take up to eight detached units, and a junior ADU's owner lives on the lot only while the bathroom is shared. The City posts four pre-approved detached plans and waives the plan check fee on them, and it adopted the State's 2025 fire map with three creek corridors added as high zones.

BHI Builders takes on ADUs, remodels, additions and custom homes in Vista, where four City pre-approved plans with no plan check fee and a grading clearance before submittal shape most backyard units. Every rule on this page traces to a City of Vista document or a state statute.
Who issues permits here, and how does plan check run?
The City of Vista's Building Division issues building permits inside the city limits, and the City now takes building and fire permit applications entirely online through its permit portal. Planning confirms the zoning first, and Land Development Engineering clears the grading before the plans are accepted at all, which the City's ADU page states in so many words. A soils report is mandatory unless the footings go 24 inches or more into competent soil, a septic lot needs the County's health clearance, and the house becomes unit 1 and the ADU unit 2 at the same address.
The City's chapter sets the decision: ministerial, by Community Development, within 60 days of a complete application, deemed approved if the City does not act, with an ADU filed beside a new house allowed to wait for the house. The chapter writes no completeness notice; the statute adds one within 15 business days. The City publishes no building plan check turnaround, but Vista Fire Rescue's prevention division aims to return its first comments on a new building within ten working days, and an application with no permit issued after a year is treated as abandoned unless extended.
How long it has taken in practice is on the City's own spreadsheets of issued permits, from the day an application was entered to the day the permit issued: for a detached ADU the median ran from about 290 days in 2023 and over 400 in 2024 down to about 190 in 2025 and under 150 so far in 2026. Those spans include the applicant's corrections and the grading clearance, so they measure the whole path, not the City's review alone.
For the projects homeowners bring most often:
- An ADU or junior ADU: the grading clearance, then the building permit through the portal, decided in 60 days of a complete application, with the plan check fee waived on one of the City's pre-approved plans and the impact fees only above 750 square feet.
- A kitchen or bath remodel that moves plumbing, wiring or walls: the portal's building permit, valued at the City's rate and checked under the 2025 codes in force since October 2025.
- An addition or a second story: the zone's standards, school fees above 500 square feet, sprinklers throughout the house when the addition passes half its size under the City's fire code, and a grading permit beyond the minor grading threshold.
- A new house: full plans with the grading clearance and the soils report, the 2025 Wildland-Urban Interface Code and Zone 0 in a hazard zone, the flood rules along the creeks, sprinklers under the City's fire code, and the park, streets and signal, public facilities, fire and drainage fees by the unit.
Where do Vista's ADU rules differ from state law?
Vista's ADU rules are Chapter 18.31 of the Development Code, rewritten by Ordinance 2022-16 on October 4, 2022, 4 to 0, and amended by Ordinance 2024-02, introduced and adopted on March 26, 2024 on a 4 to 1 vote with the mayor opposed and in force from April 26, 2024, which let a detached or attached unit have three bedrooms up to 1,200 square feet. The City Clerk's folders hold nine ordinances for 2025 and eight for 2026 through September, and none touches the chapter, so it still reflects neither the 2024 renumbering nor the 2025 bills and still cites the old section numbers. The City's FAQ of July 2025 has already moved on one point, giving the statute's eight detached units on a multifamily lot.
So the table reads the chapter with the statute, and the list after it says where the chapter, the codified copy and the FAQs still read differently. Where the chapter sets an objective standard a city may apply to an ordinary custom ADU, the City applies it; on the units state law makes every city approve, the statute's own terms govern, and no City document says which units the City holds to its extras.
| Rule | In the City of Vista |
|---|---|
| Where | The R-1-B, R-1, E-1, A-1, O-R, R-M and M-U zones and every specific plan area that allows single-family houses by right; a converted unit on any lot zoned for houses or apartments by right. |
| Units on a single-family lot | One unit inside the house or an existing accessory building, with 150 square feet added for its entrance, or one junior ADU; plus one new detached ADU with 4-foot side and rear setbacks; the detached unit may sit beside a junior ADU. The statute's combination of a converted unit, a detached 800 square foot unit and a junior ADU governs where the chapter reads narrower. |
| Multifamily lots | Space nobody lives in converted to at least one unit and as many as a quarter of the building's count; detached units, two under the chapter and up to eight under the statute and the City's 2025 FAQ, never more than the building's own units; no junior ADU. |
| Size and bedrooms | A detached or attached ADU up to 850 square feet with fewer than two bedrooms, or 1,200 with two or three, three bedrooms at most; an attached one no more than half the house; a conversion not limited; a junior ADU 500; every unit at least 150. The codified copy drops "or three" from one line and the FAQ puts two bedrooms at 850; Ordinance 2024-02 governs. |
| Height | One story and 16 feet to the roof's peak under the chapter, and a unit over the house or a garage 16 feet above the first-floor ceiling; a conversion keeps its height. The statute's floors govern above that: 18 feet within a half-mile walk of major transit, with 2 more for a matching roof pitch, 18 on a multistory multifamily lot, and up to 25 for an attached unit. Stacking one ADU on another is not allowed. |
| Setbacks and separation | None for a conversion. For a new unit, the house's front setback, 4 feet from the side and rear lines, 10 feet from a corner lot's side street, and 5 feet eave to eave from every other building, patio cover, shed and pool. The front setback cannot stop an 800 square foot unit, and the statute's own units take only its 4-foot rule. |
| Design | A match with the house is encouraged, not required. |
| Parking | One covered or uncovered space, tandem or in a side or rear driveway, which the City may refuse on topographic or fire findings; uncovered spaces lost to the unit are replaced, covered ones need not be. None near transit, in a historic district, for a unit within the house's footprint, where street permits are not offered, near a car share, or, under the statute, with a new house. |
| Sprinklers | None when the house has none, under the chapter, the statute and the City's own pre-approved plans, which cite the Residential Code's ADU exception. The City's fire code, amended in September 2025, requires sprinklers in all new buildings with exceptions only for small utility buildings and greenhouses; for an ADU the statute governs, and the plans show how the Building Division reads it. Ask Vista Fire Rescue at intake. |
| Solar | A new detached ADU that is not a manufactured home meets the same solar requirement as a new house. |
| Junior ADU | One per lot, up to 500 square feet inside the house, with its own entrance, an efficiency kitchen and a recorded deed restriction in a form the City Attorney approves. The chapter and the FAQ want the owner living on the lot whatever the bathroom arrangement; the statute, since January 1, 2026, asks that only of a unit sharing the house's bathroom, and governs. |
| Owner occupancy | None for an ADU. A junior ADU as the row above says. |
| Rentals | The chapter and the page say no less than 30 consecutive days; state law wants a term of more than 30 days, which makes 31 days the shortest lease. No ADU or junior ADU may be a short-term rental under the City's rental chapter. |
| Selling a unit on its own | Never for a junior ADU. For an ADU, only by way of the qualified nonprofit route the statute sets out; Vista has no condominium ordinance. |
| Fees | No impact fee on an ADU of 750 square feet or less; above that, a share in proportion to the house; every impact fee waived for ten years when the unit houses a lower-income household, a family member or a caregiver under a recorded agreement. School fees from 500 square feet. Water and sewer connection fees and capacity charges only for an ADU built with a new house. |
Where the City's documents still read differently from the statute, and what governs:
- Height, the multifamily count, junior ADU occupancy and the rental term: the statute, as the table says.
- The fee waiver page says fees are waived on an ADU less than 750 square feet and its FAQ that one over 750 qualifies for the ten-year waiver, which leaves a 750 square foot unit in neither class; the chapter and the statute say 750 or less pays no impact fee, and govern.
- The front setback, the 5-foot separation, the corner side street setback and the parking replacement are standards the City may apply to a custom ADU; on the units the statute makes the City approve, the statute's own terms govern.
- The sprinkler rule, as the table says. The City's 2024 FAQ is still posted beside the 2025 one with the old two-unit multifamily limit; the 2025 FAQ and the statute govern.
Can you build from a pre-approved ADU plan here?
Yes, and the plan check fee is waived when you do. In March 2024 the City obtained the County's leave to use the County's six standard ADU plans in Vista and set aside money for four plans of its own, which Design Path Studio drew and the City posted on June 18, 2026 as the City of Vista Pre-Approved ADU Program: a 499 square foot studio, a 745 square foot two-bedroom, one-bath, a 749 square foot two-bedroom, two-bath, and a 1,194 square foot three-bedroom, each with Craftsman, Spanish and Traditional elevations and drawn to the 2025 codes. The City's page labels the largest 1,149 square feet; the plan's own title sheet and the 2024 staff report say 1,194. The owner adds a site plan, a site-specific energy report, a construction waste form and a hold-harmless agreement; permit and inspection fees still apply; the program is for single-family lots. The City's spreadsheets show ADUs built from its plans since 2024.
Two things to confirm with the City: whether the County's six plans are still accepted, since the page lists only the City's four, and whether the City takes an outside designer's plan for pre-approval and decides it in the state's 30 days, which no City page says.
Fire, grading, the creeks and the specific plans
Vista adopted the State Fire Marshal's map of March 24, 2025 by Ordinance 2025-03 on June 10, 2025, after a comment period that closed June 1, and added Buena Vista Creek, Buena Creek and Agua Hedionda Creek as high fire hazard zones of the City's own; a parcel split between zones takes the highest. In September 2025 the City adopted the 2025 Fire Code and the 2025 Wildland-Urban Interface Code, with Zone 0 within 5 feet of a building, and the April 2025 vegetation ordinance carries defensible space out to 100 feet. A new building in a hazard zone is built to the interface code.
Vista has no hillside or ridgeline chapter; its grading chapter does that work. Minor grading is 50 cubic yards or less with no cut or fill slope over 5 feet, general grading runs under 2,000 cubic yards and engineered grading above, and extra measures may be asked on geologically unstable ground and on slopes of 25 percent or steeper, which the pre-approved plans also flag. Along the three creeks the flood chapter sets a new or substantially improved house's lowest floor at or above the base flood elevation, or above the highest adjacent grade in a shallow-flooding zone.
The ADU chapter reaches every specific plan area that allows single-family houses by right, the newest of them the Mar Vista plan of October 2025. No historic district has been designated, so the only historic rule is the parking waiver. A movable tiny home is not yet defined in the code; the Council sent proposed rules to the Planning Commission in February 2026 and nothing has been adopted. The City's January 2026 climate update reports no building reach code, and the 2025 Energy Code is adopted without an electrification amendment.
Which fees apply, and where are the schedules?
The City's fee schedule updated on July 1, 2026 prices a building permit by valuation, with plan check beside it, a repeat plan check at a quarter of the first, the fire department's review as a share of the building plan check, and a set fee for a single-family sprinkler system and for a certificate of occupancy. Impact fees are paid at issuance or, on request, deferred to completion, at the rate in force when they are paid; the park fee was raised on August 14, 2026.
- Impact fees. The fire protection, public facilities, park and streets and signal fees are set per unit and the drainage fee by basin; none applies to an ADU of 750 square feet or less, and a larger unit pays a share in proportion to the house, which no City document works out. The City's fee waiver program waives every impact fee for ten years on an ADU that houses a lower-income household, a family member or a caregiver under a recorded agreement, signed before the fees are paid.
- School fees. Vista Unified charges by the square foot on new residential units, ADUs named, and on additions of 500 square feet or more, and none on construction under 500; parts of the city lie in San Marcos Unified.
- Sewer. The City's own sanitation district or the Buena Sanitation District, by where the lot sits, each with a connection fee per equivalent dwelling unit and a fee for the availability letter; neither names an ADU, and under the chapter and state law an ADU pays a connection fee or capacity charge only when built with a new house.
- Water. Vista Irrigation District re-evaluates a property's meter size when an ADU is added, sets a minimum meter of 3/4 inch, and charges its capacity fee and the County Water Authority's charge by meter size on a new connection; it publishes no ADU exemption, and state law bars a capacity charge on a unit inside existing space.
- Everything else. The grading inspection and the soils report review where they apply, an encroachment permit for work in the street, and the County's health clearance on a septic lot.
How many ADUs Vista permits
Vista's ADU permits climbed fast after 2019: none reported in 2018, 131 at the peak in 2024, 100 in 2025.
- 02018
- 22019
- 512020
- 602021
- 792022
- 1052023
- 1312024
- 1002025
Units Vista reported to HCD as ADU building permits by reporting year (Table A2, ADU category), not units finished, with junior ADUs inside the figure since the form has no category for them; the 2023 report holds one unit from 2021 and one from 2022. The City's own staff report counts 71 ADU permits for 2023 (40 detached, 22 attached, 9 junior), a different measure from the state's units, and its Housing Element counted 51 for 2020, matching the state's.
Recent changes in Vista
What has changed in the City's permit rules since 2024, newest first.
Vista's chapter still names one new detached ADU, and no City fee page works out the proportional share above 750 square feet; in 2027 state law doubles that count and limits the share to the area past 750 on lots with up to two ADUs. The guide covers each.
Vista Irrigation District revised its rules and regulations; the rule that it re-evaluates a property's meter when an ADU is added stands as revised in January 2024.
The City's new park fee took effect, under the fee schedule updated July 1, 2026.
The City posted its four pre-approved ADU plans, drawn to the 2025 codes, with the plan check fee waived on each.
The Council sent proposed rules for movable tiny homes to the Planning Commission, 5 to 0; none adopted since.
The state's housing department asked the City about two Housing Element programs on parking and development standards missing from its 2024 report; nothing in the letter concerns ADUs.
The 2025 Building, Residential, Fire and Wildland-Urban Interface Codes took effect, adopted September 23, 2025, with the fire code's sprinklers in all new buildings and Zone 0.
The City reissued its ADU FAQ, giving the statute's eight detached units on a multifamily lot where the chapter still says two.
Ordinance 2025-03 adopted the State Fire Marshal's map of March 24, 2025 and added Buena Vista, Buena and Agua Hedionda creeks as high zones.
Ordinance 2025-02 rewrote the vegetation management and defensible space rules.
The short-term rental chapter was enacted, excluding every ADU permitted under the City's ADU chapter; permits began July 1, 2024.
Ordinance 2024-02 took effect, allowing three bedrooms in an ADU up to 1,200 square feet; adopted March 26, 2024, 4 to 1, the same night the Council funded the City's own pre-approved plans and the City secured the County's.
How BHI approaches a Vista project

On a Vista lot we look first at the grading clearance Land Development Engineering gives before plans are accepted, then at whether one of the City's four pre-approved plans fits, and at the creek corridors the 2025 fire map added. Book a call to talk through yours.
What an ADU might rent for in Vista
No one publishes a rent for ADUs on their own, so the table gives HUD's FY2027 Small Area Fair Market Rents for Vista's three ZIP codes, the ROI calculator's starting point: for each size, the rent that four in ten recent movers pay less than, utilities in.
| ZIP | Studio | 1 bed | 2 bed | 3 bed |
|---|---|---|---|---|
| 92081 | $2,420 | $2,580 | $3,120 | $4,140 |
| 92083 | $2,170 | $2,310 | $2,790 | $3,700 |
| 92084 | $2,020 | $2,150 | $2,600 | $3,450 |
HUD's FY2027 rents for ZIPs 92081, 92083 and 92084 by bedroom count, the figures the ROI calculator holds; a ZIP that crosses the city line sits under Vista because most of its people live there. Run your own lot through the ROI calculator for 30 years.
